Every person should get the treatment on time in case of an accidental patient diet due to not getting in the case and accidental without delay this is the basic idea behind our medical system. The right to health is considered as our basic human right. And human rights are the right that a human being possesses from birth till the last breath. Human rights are the fundamental right of every individual and this right to health is covered and the umbrella of human rights.

HEALTH AND HUMAN RIGHTS

As discussed our right to health is the basic human right that every person is headed for from the very beginning of his life by declining this right we ultimately ignore our human rights which leads to the violation of human rights. If a person does not get to the medical facility on time or if any hospital is denying to give treatment to the accidental person that institution hospital is violating the human right.

Why deny the treatment not only right to health is been ignored but also another human right which is right is also being ignored. In case an accidental patient died due to not getting the treatment just because the formalities of police and others are not fulfilled then this is really shameful and a major violation of human rights but with the advancement in technology and society, our laws are also improvised to bring more justice and fairness in society.

Earlier, due to not getting treatment on time, there were a number of people who died in accidents but now things have improved for the better and there are laws being enforced to reduce these deaths.

GOOD SAMARITAN LAW

When an accident occurs on the road. it is the bystanders or local public who helps the victim earlier, these local avoid helping accident victims as they fear legal repercussion. They also fear procedural issues including harassment by police. But now this is not the scene this law which is called ‘ GOOD SAMARITAN LAW ‘ protect those who help the victim of the accident.

DEFINITIONS OF GOOD SAMARITAN

A good Samaritan is a person who comes forward to give immediate help and care to a person injured in an accident a good Samaritan in good faith comes forward to help with his own will. The law comes into force in the year 2016 which protects the good Samaritan. The Supreme Court of India directs the central government to protect the goods Samaritan under this law.

The motor vehicle amendment act 2009 also inserted section 134 which is named ‘Protection of Good Samaritan’  which says good samaritans shall not be liable for any harm or dash to the victim of an accident. This good summer written act protects and health those who help the victim of the accidents so that the fear that they had in their mind will run away.
