Lok Adalat cannot convict or punish any person, Allahabad High Court stayed the order of CJM

Recently, the Allahabad High Court in Lucknow stayed the order of the Chief Judicial Magistrate, under which the CJM, acting as a Lok Adalat, convicted a person and sentenced him to a fine. Justice Karunesh Singh Pawar passed the order on a petition filed by Surya Kumar and others under section 482 of CrPC.

Marriage is not invalid if the boy is not more than 21 years old, an adult can live with a person of his choice: Allahabad High Court

The Allahabad High Court observed that while it is well established that an adult has the right to live with someone of his own free will, the fact that the married boy is not more than 21 years of age will not invalidate the marriage. A division bench of Justice Ashwini Kumar Mishra and Justice Shamim Ahmed clarified that at the most, it may make the person liable to punishment under section 18 of the Hindu Marriage Act, 1955.

Allahabad High Court order, transgender can also adopt a child.

Allahabad High Court has given a big order regarding transgender. The court has said that even a transgender woman can adopt a child. The court said that any child can be adopted under the Hindu Adoption and Maintenance Act, 1956 by single parents. This order was given by a division bench of Justice Dr. Kaushal Jayendra Thakur and Justice Vivek Verma while hearing a petition filed by a transgender woman Reena Kinnar and her husband. The Allahabad High Court observed that as per Section 202(1) of CrPC if an accused resides outside the jurisdiction of a Magistrate, it is mandatory for such Magistrate to proceed under Section 204 of CrPC. that he may either investigate the matter himself or direct an inquiry.
