- Summarization:-
The public gives birth to some essential protections that we name human rights. As impunity is fairness to stipulate that no one differently’s conduct can or should do against the will of the existent. The conception behind this is that people must be shielded from atrocity and dangerous treatment.
The media, continually considered the fourth pillar of the republic, may contribute enormously tremendously to the defence of human rights. In my opinion, the word “ media”, the description of “a way for two individualities to communicate with one another,” is the original ancestor of the word media.
The media’s primary purpose should be to fleetly allocate knowledge to the general public. This implies that the sooner human rights are shielded, the more active the media is.
- Preface:-
Media platforms and human rights have a veritably profound significance, which exists also as a right-handed in our Indian constitution, for a common man, the use of media can save human rights from being violated.
Human rights are the introductory rights available to any human being by birth in the human race. It’s essential in all human beings irrespective of their nation, religion, language, gender, colour, or any other reflection.
The Protection of Human Rights Act, 1993 defines Human Rights as: “human rights” means the rights relating to life, liberty, equality, and pride of the individual guaranteed by the Constitution or illustrated in the International Covenants and enforceable by courts in India”
- Freedom of Media in India:-
Article 19 (1)(a) of the Indian Constitution protects the right to “speak, write, print, photograph, or otherwise visually or audibly communicate” one’s beliefs and statements. This provision is figured out to include the right to disclose and transmit knowledge in print.
This would include the right to communicate one’s self-sense and the freedom of the press. Newspapers, magazines, and movies are all realisable channels for transmitting the information.
Freedom of speech is the ‘genuine’ from which press freedom emerges as a species.’ Therefore, press freedom in India is on an original footing with the right to free speech and accomplishes not enjoying any special benefits beyond those enjoyed by every citizen.
The case of Maneka Gandhi vs Union of India (1978), was a landmark decision of the Supreme Court of India in which the Court significantly expanded the interpretation of Article 21 of the Constitution of India.
It was repealed in A. K. Gopalan v. The State of Madras, which had inferred the exclusiveness of fundamental rights, verified a relationship between Articles 14, 19, and 21 of the constitution, known as the (golden “triangle” or trio) efforts that a law restraining a person of ‘personal liberty’ must not violate any of them. Formerly again overruling A. K. Gopalan, the Court, in this case, held that a ‘procedure’ under Article 21 of the Constitution cannot be incidental, one-sided, unjust, or inflexible.
- The Role of Media in human rights:-
The media plays an important role in shaping public sentiment through news reports, editorials, and other forms of content, the media can influence people’s beliefs and philosophies. This can be used for good or for bad, being sure of the motivations of those behind the media.
It is important for media platforms to be responsible in their reporting and to provide factual and balanced knowledge to the public. This helps to ensure that the public is informal and can make informed decisions. The media should also prefer to present different standpoints and allow for open and honest debate on critical issues on human rights.
As previously mentioned that human rights include many kinds of fundamental rights that cannot be violated by anyone, In the case of the People’s Union of civil liberties (PUCL) (1996) vs. Union of India, the supreme court held that tapping someone’s phone without any appropriate prevention, or without following the procedure established by law, was a violation of the fundamental right to privacy of a person.
- Advantages of media in human rights violations:-
The media retains a huge contribution to the structure and advancement of India or any other country, there were countless experiences in history when recognizing the power of media, and people used it for public transformation.
Whenever injustice is done to anybody in a state or any other nation, the media plays a vital role in that malfeasance activities to promote justice for all, for example, in the Nirbhaya incident in Delhi and many such incidents, the government was able to punish all the culprits through the media platforms through the dharna demonstration begins in the country.
The communication related to all the developmental work that is being done today, the issues of human rights abuses, and the contentious incidents that are stretching out rapidly, would not be reached us as fast as it reached with the help of the media, it is clear that today the media’s playing it’s an effective and positive role in human rights.
Politicians, actors, industrialists, etc. turn their crowns before the power of media. In today’s era, the media has an important role in every field, As we were talking about the protection of human rights by the media, the human sensation is.
The feelings related to good or bad events in human life from the beginning to the end, that’s it, for a human the rights which are given by the government are important for them to be safe and secure, for this, the media can be a good medium for human rights protection. In this, the media must put human emotions in front of society with great caution, which is a matter of fact in which no person or society is harmed.
- Disadvantages of media in human rights violation:-
Media platforms are not only a boon but also a curse, there are some disadvantages of media regarding human rights. In the current scenario, the media is forgetting its responsibility due to demand and selfishness.
In the newspapers, in the name of human rights abuses, most of the news of police detention and jail activities, and deaths are published. But incidents of human rights abuses do not find the place that should be found. The media needs to focus on the issue of protecting the rights of the deprived, but the media ignores the important aspects of human rights and only takes up their ratings which is unfair.
Nowadays the media is interested in covering people belonging to such a class, to which he or she feels connected. Because of this partisan thinking of the media platforms’ partiality in standards of the class, the coverage of events that took place in the life of the same class is given more attention, and because of that reason, the criminal cases on lower class are not easily registered even in the local police stations.
- Conclusion:-
As we talked about before, the media platforms’ involvement in human life and rights infringement. The role of Media in People’s opinions can only be expressive when its ownership and management are democratic and fine and conveys human rights. Regardless, it is also true that human rights are essential for the media itself.
In today’s scenario, the media is also facing complications in functioning due to needy human rights situations. From the beginning to the end of the above discussion, it is clear that the media is always protecting human rights from violation, but in some situations, the media should pay more attention to the daily abuses of human rights violations than their interest.
