Introduction

India is a nation of deep-rooted traditions especially when we talk about casteism, that’s why issues like untouchability, casteism, and hate crimes are still functioning between us. Millions of people relating to the bottom class system are facing humiliation by the stereotypical minds of the Nation.

Not only adults but as well as children and their female members are facing these issues in schools, colleges, society, and even in playgrounds too. so in today’s topic, Ankita Chauhan will let you people know about every corner of this crime.

CASTE-BASED DISCRIMINATION & HATE CRIMES

There are six fundamental rights in India. They are
● Right to Equality,
● Right to Freedom,
● Right against Exploitation,
● Right to Freedom of Religion, Cultural and
● Right to Educational
● Right to Constitutional Remedies.

Any form of communication or conversation or act against a caste identity of an individual person or a group of persons by any Abusive act or humiliating and dehumanizing them on the basis of their bottom caste order is known as Caste Based hate Speech and hate Crime.

For example,
In Part of India, most Dalit face these humiliating words from upper groups of caste order. Hence many research Agencies and Organisations have stated that, where there is caste discrimination in a society, that society has to face caste-hate crime too.

In a recent year, research based on caste discrimination noticed that more than 260 million Dalits worldwide have been suffering from these types of issues, especially Dalit women. Thus caste-based discrimination and hate Crime is a really critical Human Rights violations which must be addressed by the law and order of a particular Nation.

Hate Crime in India

There is no doubt that our Holy Indian Constitution strictly objects to and guarantees protection of equality and provision of discrimination on grounds of religion, race, caste, sex, and place of birth under Article 14 but despite these laws, hate crime has always been a black mole on the clean character of our nation.

LAW BANNING CASTE-BASED DISCRIMINATION AND HATES CRIME

Friends Hate crime in our Indian Constitution is like a faded Shadow which can’t be well defined nor can be easily converted into a proper form, However some of the sections of the Indian penal code deal with the Hate crime like 153A, 153B, 295A, 298,505(1)and 505(2) which clearly signifies that any type of spoken or written word that promotes dehumanizing hatred or abusive insults on the basis of religion, ethnicity, caste, race, color, language, etc all are punishable under law.

Essential Elements Relating Caste Discrimination & Hate Crime

  • Caste-Based order
    In India, casteism has been in action for several years. We have a long history of caste-based discrimination where people were respected on the basis of their caste group due to which collapse between several caste groups led to the perpetration of hate crimes in nature.
  • Political benefit’s
    Nowadays a group of castes has become a vote bank for politicians, in order to be in power they enforce such people for their own benefit. Sometimes these types of enforcement create a very dangerous situation for the law and order to handle such as Riots during election time.
  • Religious and Ethics
    We all know that India is a secular state where different types of religious and ethical groups have the right to live freely and happily with enormous fundamental rights. But on the other hand, these multitudes of religious and ethnic groups lead to violence and hate crimes.
  • Misconception and Misinformation
    The spread of rumors and hate speech on any type of social media platform can fuel tension between different religious groups in a settled country and can be the reason for Hate crimes. especially now a day’s when people are gaining knowledge from what’s up university…

Essential Elements to Control Caste Discrimination & Hate Crimes in India

  • Strict and Rapid Penalties:
    Imposing strict and Rapid penalties for the people engaged in hate crimes can decrease the chance of Perpetration of Hate crimes. This can serve as a washing Powder for the people who were trying to function as a hate crime…
  • Public Awareness Programs:
    There should be a door-to-door campaign awareness program addressing hate crime and its disadvantages to society. Media campaigns can also play a vital role in minimizing hate crimes as well as educating school children on different platforms can make the upcoming generation aware.
  • The help of Technology:
    We all are living in the era of Technology, which can be used for tracking and improving records of hate crimes. This can also be helpful for the government by creating new apps and websites to identify the Trends and hotspots for Hate crimes.
  • Community engagement :
    Community is the first step to making any society better and more helpful. In order to minimize hate crimes, the engagement of the community is very important. this can be done by bringing every single group of people in one place and making them free for an open and honest discussion about various topics relating to caste discrimination and the caste system.
